EIA/EC NOC from SEIAA/MoEF

What is Environmental Impact Assessment (EIA)

Environmental Impact Assessment (EIA) is a systematic study carried out to anticipate, evaluate, and address the environmental, social, and economic effects of a proposed project. It applies to both new and existing developments during their construction and operational phases. By identifying potential risks in advance, EIA enables project developers and regulators to make informed decisions that balance growth with environmental protection.

EIA is legally required for a wide range of projects, including infrastructure, industry, and mining, as outlined in the EIA Notification, 2006 (and its amendments) under the Ministry of Environment, Forest and Climate Change (MoEFCC).

Regulatory Background of EIA

  • Governed under Section 3 of the Environment Protection Act, 1986 and Rule 5 of the Environment Protection Rules, 1986.
  • The EIA Notification, 2006 consolidated and replaced earlier regulations and continues to guide the clearance process.
  • Projects are categorized into Category A, B1, and B2, depending on their size, type, and potential impact.
    • Category A – Appraised directly by MoEFCC.
    • Category B1 – Require a full EIA study and clearance by SEIAA/SEAC.
    • Category B2 – Exempt from full EIA studies; cleared on the basis of simplified submissions.

Environmental Clearance Procedure under EIA Notification, 2006

  • The environmental clearance process typically includes:

    1. Screening – Determining project category and need for EIA.
    2. Scoping – Defining Terms of Reference (ToR) for detailed assessment.
    3. Public Consultation – Seeking views and concerns of affected communities.
    4. Appraisal – Expert evaluation of project details and EIA study.
    5. Decision – Grant or refusal of Environmental Clearance (EC).

For construction and township projects (Item 8 of the Schedule), scoping is not mandatory; appraisal is based on prescribed forms and the conceptual plan.

Steps for Obtaining EIA Clearance from SEIAA

  1. Project Proposal – Preparation of a detailed project report (DPR) including technical and environmental details.
  2. Expert Review – Evaluation by subject-area specialists in environmental fields.
  3. Site Inspection – Assessment of site suitability, accessibility, and surrounding environmental features.
  4. Baseline Data Collection – Seasonal monitoring of air, water, noise, soil, and related parameters through NABL-accredited laboratories.
  5. Submission to Authorities – DPR and supporting documents filed with SEAC/SEIAA.
  6. Appraisal Presentation – Project proponent presents the case before SEAC/SEIAA.
  7. Issuance of Clearance – Environmental Clearance (EC) is granted after compliance with prescribed conditions.

Validity of Environmental Clearance from MoEF

  • For building, township, and area development projects, the clearance is valid for seven years.
  • Before expiry, proponents must apply for extension or renewal with an updated project report.

Post-Environmental Clearance Compliance

Once EC is granted, the project proponent must submit compliance reports twice a year (in June and December) to demonstrate adherence to the stipulated conditions.

Why EC Compliance Reporting is Required?
  • Ensures mitigation measures committed in the EIA report are actually implemented.
  • Provides regulators with updates on environmental performance during construction and operations.
  • Helps monitor the adoption of improved pollution control and sustainability measures.

Environmental Monitoring Requirements

  • Regular testing of air, water, noise, soil, and other relevant environmental parameters.
  • Monitoring conducted by accredited laboratories in line with CPCB/SPCB/MoEFCC guidelines.
  • Any deviations from standards must be corrected through technology upgrades or stricter pollution control practices.
